Ordinance No. 6 of the Governor-General of Korea

 

The regulations for the recruitment of laborers are as stated below.

Regulations for Recruitment of Laborers

 

Article 1

Persons recruiting laborers to engage in projects located outside Korea shall submit a written application indicating the matters listed in the items below, with a draft contract of employment attached, to the chief of the police affairs department in the recruitment area concerned and receive permission.

 

  1. Legal domicile, address, occupation, name, and date of birth; in the case of a company: company name, business, main business office location, name and address of representative
  2. Type and location of work the laborer shall engage in
  3. Number of men, women and special labor personnel
  4. Age groups of the laborers to be recruited
  5. Recruitment area and period of work

 

If any change is made to items 2. through 5. above or to the provisions of the employment contract, the above clause shall likewise apply.

 

Applicants to engage in recruitment or their representatives who do not have an address in Korea shall determine a temporary address in Korea and report this to the chief of the police affairs department and shall also notify the chief of the police affairs department in the event of any change in this address.

 

Article 2

The following matters shall be indicated in the draft contract of employment stipulated in the previous article.

  1. Type of work
  2. Period of employment
  3. Working hours and breaks
  4. Wages and their payment
  5. Method of savings
  6. Ways to encourage work
  7. Accommodation
  8. Ways to pay for meals, baths and other daily living expenses
  9. Ways to pay for round-trip transportation expenses
  10. Medical treatment in the event of injury or illness and their payment
  11. Wages and their payment during leave due to injury or illness
  12. Allowance, solatium, condolence money, etc. and their payment in the event of disability or death from injury or illness
  13. Ways to pay for round-trip transportation expenses of parents, siblings or other relatives affected by a worker’s injury, illness or death

 

Article 3

When the recruiter employs an agent to engage in recruiting, he shall indicate the legal domicile, address, occupation, name and date of birth of that agent on the written application, submit it to the chief of the police affairs department and receive permission.

 

When the recruiter employs an agent to engage in recruiting, he must carry a certificate of permission.

 

Article 4

Recruiters shall observe the following.

  1. They shall not conduct recruitment by concealing the truth, exaggerating or lying.
  2. They shall not recruit any persons under the age of fourteen.
  3. They shall not recruit any persons under the age of twenty without written permission from their parents or guardians nor recruit any women without the written permission of her husband.

 

Agents engaging in recruitment shall not conduct recruitment by concealing the truth, exaggerating or lying.

 

Article 5

Recruiters shall draw up a register of applicants for work indicating their legal domicile, address, occupation, name and date of birth and shall submit it prior to departure to the place of recruitment to the Chief of Police (including the chief of the military police unit and military police station performing the work of the police station; the same shall apply hereinafter).

 

In the case of the previous clause, when it is deemed necessary, the Chief of Police may order the submission of a certified copy or partial copy of the applicant’s family register and the written permission stipulated in item 3. of the previous article.

 

Article 6

When a recruiter is to have applicants embark on a voyage outside of Korea, the place of embarkation and date of departure shall be scheduled and a notification with the register of applicants and copies of the recruitment permission certificates attached shall be submitted to the Chief of Police in the place of embarkation three days prior to departure, and the same shall apply in the event that any change is made to the place of embarkation or date of departure.

 

In the event that any change is made to the matters recorded in the register of applicants submitted as stipulated in the previous clause, notification of this shall be made by the date of departure.

 

Article 7

In the event that the recruitment area covers two or more provinces, the written application or notification stipulated in Article 1 or Article 3 above shall be submitted to the Inspector General.

 

Article 8

In the event of any violation of the laws and ordinances relating to recruiters or if it is deemed necessary for the public good, the Inspector General or chief of the police affairs department may cancel the permission stipulated in Article 1 or Article 3 above.

 

Article 9

When the Chief of Police deems it necessary, he may temporarily suspend recruitment of persons who have received permission in accordance with Article 1 or Article 3 above and issue necessary orders regarding other regulations on recruitment.

 

Article 10

The documents submitted to the Inspector General or chief of the police affairs department in accordance with these Regulations shall require the approval of the Chief of Police with jurisdiction over the address or temporary address stated in the application.

 

Article 11

Persons to whom any of the following apply will be subject to a maximum penalty or fine of 200 yen.

  1. Recruiting without permission for the sake of oneself or another person
  2. Engaging in recruitment without receiving permission as stipulated in Article 3 above
  3. Violation of Article 3, paragraph 2, or Article 4 above
  4. Failure to submit documents as stipulated in Article 5, paragraph 1, or Article 6 above
  5. Violation of an order in accordance with the stipulations of Article 5, paragraph 2, and Article 9 above

 

Article 12

In the event that an agent engaged in recruiting commits a violation of these Regulations or an order in accordance with these Regulations, the recruiter cannot be exempt from punishment on the grounds that it was not committed under its own superintendence.

 

Article 13

In the event that a company undertakes recruitment and the representative of that company violates these Regulations, the penalty stipulated in these Regulations shall be applied to the company.

 

If a penalty is imposed on a company, the representative of the company shall be the defendant.

 

Article 14

These Regulations shall not apply to persons handling emigrants in accordance with the Emigrant Protection Act.

 

 

Supplementary Provisions

 

These Regulations shall come into force on February 1, 1918.

 

Persons receiving approval for recruitment before these Regulations come into force shall be deemed to have received permission in accordance with these Regulations.
